President Trumps rolls out new Executive order on Crime

 On Feb 8, 2017 President Donald Trump signed an executive order on crime. The magnitude of this order will not be felt, until the presidents special Task Force starts combing the streets of America, using federal statutes to mandate harsher sentences on offenders. The main objective of this task force is to combat crimes of violence, cartels and offenses against law enforcement officers.  We at CSB know the importance of providing a clear understand about laws and their potential to America’s citizen’s, because in a court of law ” ignorance of the law is no excuse.” That being case, under Trumps new order If you or your a love one finds themselves in a minor conflict with law enforcement i.e, (simply resisting arrest) you or them will now be facing a federal charge which could mandate a mandatory minimum sentence.
(Note: The federal court system compared to most state courts, have a lesser burden of proof when it comes to its staggering 95% conviction rate.)
 Remember over the last couple of year allot of the police shooting and the killing of innocent people began as a simple resisting arrest offense and resulted in deaths. So a federal charge for such offenses could run rampant in certain states and communities if we the people aren’t proactive with regard to abuse of federal charges when it comes to these offenses.

If you think this is a impossible probability then consider the fact that, Trump has been president for a little over two weeks and he’s pass quite a few executive orders, each one has come in with some level of controversy and little to no forethought, with regards to the effects his executive orders will have on American citizen. For example look at the confusion and the constitutional violation his travel ban as create.

Therefore, beware of what’s to come in your city and communities. It is my prediction that Chicago will be the first city to come under attack, because of the surmountable gun violence within the inner city last year. Those affiliated or associated with any gangs will be the main target of the task force and will find themselves facing some serious penalties as well as new law enforcement tactics like a DNA test that takes 90 minutes to bring back results, high tech drones that will monitors high crime area’s and ect.

Mexican drug dealer linked to cartels by any means will face serious sentences and the burden for establishing their association will not be based on “Beyond a reasonable” in which a jury of your peers much establish guilt. It will based on a “preponderance of evidence” in which a federal judge establishes the facts that deem you are an affiliate of a drug cartel.
Note: Few federal judges disagree with the governments position when it comes to the government laying out what the deem are the fact of a federal case.)

 Last year Congress was close to passing legislation that would requires any illegal immigrant caught bringing drugs in the United States be sentence to a mandatory life sentence.
Last year this bill needed bipartisan support, this year the republican control the house and the senate. You can bet your bottom dollar that this year this bill will past. Especially with Trump telling the president of Mexico his first week in office ” You have not done a good job dealing with the drug cartel.”

If we have learned nothing over the past few weeks when it comes to Donald Trump, he says what he means and means what he says (Wrong or Right). His new Attorney General Mr. Session is a hard liner when it comes to being tough on crime.

Session was a congressman who believed in harsh sentencing and being tough on crime regardless of the racial disparities, and unconstitutionality of these laws, during his confirmation hearing he made promises that as Attorney General he would focus on crimes of violence and that he would enforce the law on to the fullest.  In  my opinion Session plans to make history and what we will see in the years that lie ahead is surely going to be one for the history books.

The law and those that enforce it can be a double edge sword… It more often than not makes our nation safer, but in the wrong hands the scale of justice are not balanced. We find that these harsh law makers and enforcing victimize the innocent and view is a minor casualty in light of the greater need for justice. But the principle in which our forefather built this nation is “It is better to let a thousand guilty men go free, if that law holds one innocent man in bondage.” My greatest fear is Trumps executive order will subjugate quite a few innocent men and women to some harsh federal sentences, in the name of combating crime. We’ve all seen it before with the War on Drugs, the drug law were establish with good intention, yet at the end of the day they have proven to cause way more harm than good for thousand of federal offenders. Let us learn from our history in hopes that we don’t repeat it.
