Felon Firearm Rights Restoration
by Robert Luther III, now available via Social Science Research Network: Here a summary:

The restoration of firearm rights for felons address the method by which a convicted felon under state law may be relieved of collateral federal firearms disabilities in the Fourth Circuit i.e., Virginia, West Virginia, North Carolina and South Carolina. The initiative right now is focused primarily on Virginia. It’s calling on the Fourth Circuit to make clear in an appropriate case that: “A defendants civil rights have been restored under state law for purposes’ of 18 U.S.C. 921(a)(20) if the state has also restored the defendants right to possess firearms.” The Supreme Court of Virginia has interpreted the Virginia Constitution in Gallagher v. Commonwealth, which held that the governor lacked the authority to restore firearm rights and that only the state trial court can do so, the Fourth Circuit Failure to construe 18 U.S.C 921(a)(20) as suggested will have the unintended and disparate effect of failing to relieve all state convicted felons in Virginia from their collateral federal firearms disabilities. Simply put the failure to remove a federal firearm sanction, where a felon has his firearm right restored by a Virginia Trial Court would yield a perverse result, because the purpose of 921(a)(20) is redirect the restoration process of a felons gun right back to the state. This is a highly important issue concerning millions of ex-felon who deserve a means to restoring their constitutional right to bare arms. For those of you who are ex-felon or have a love one who’s a convicted felon that would like to see your gun rights restored or a love one gun rights restored please post your comments and some of your recommendation on how we can make this initiative a national reality.

For the past decade and half, the federal Bureau of Prison has been a institution of self-education, self-evaluation and the reason I now possess knowledge of self. That being so, I now strive to expose the solution to the problems that our plaguing our communities, America's youth and this country as a whole. There's a saying: "There's nothing new up under the sun." Simply put, if there's one thing in this universe existence, that has seen all thing that mankind has done or not done, it is the sun. That means the moral dissension that taking place currently is nothing new. Historian have written about times where the moral fabric of a nation was so tattered where the only solution for change was war a destruction. This country was built and establish to be the nation it is today. By the disenfranchised, those who were being oppressed by the Queen and her fellow Aristocrats. Therefore if this country is to change once again for the better. It will begin and must begin with the actions and the voice of the disenfranchised i.e, America's minorities, poor and it's third class citizen the American Ex-felon. That being said I'm committed to "WRITING MY WRONGS..." and sewing seed of knowledge and truth that will blossom into peace, prosperity and positive change
